ARTICLE 1 - OCCUPANCY CONDITIONS
Unless otherwise stated, the maximum number of people per bedroom is two.
If a group presents itself as being composed of more persons than it was intended to be, a payment must be made immediately for the additional persons, being specified here that under no circumstances may the number of persons occupying the property exceed the maximum occupation of the property.
This maximum occupancy is stipulated in the rental agreement signed at the time of booking.
Children under 2 years old who sleep in a cot are not counted but they must be mentioned to the agency at the time of booking.
The Tenant and the other occupants of the property, for whom the Tenant is considered responsible, guarantee an acceptable and decent behavior and undertake to respect the rented premises and its equipment, return them as they are and do not cause any harm to the neighborhood.
Subletting is prohibited.
The Tenant undertakes to leave free access to the property at any time to the person responsible for the maintenance and proper functioning of the villa (the « Manager").
ARTICLE 2 - POOL SAFETY
If applicable, the pool of the rproperty is equipped with a security system in accordance with French statutory provisions (Articles L1281 and L1282 of the French Construction and Housing Code).
Therefore, the Tenant and the other occupants of the property undertake to leave this alarm in operation for the entire duration of their stay.
They further acknowledge that they are fully aware that, even in operation, the alarm is in no way a substitute for their vigilance with respect to the supervision they must provide to their child(s) or any other person(s).
ARTICLE 3 – ARRIVAL AND DEPARTURE HOURS
The arrival at the property will be from 3pm, the departure of the property must be before 11am (unless prior agreement of the agency)
ARTICLE 4 - RESERVATION AND CANCELLATION CONDITIONS
The Tenant undertakes to pay a deposit equal to 30% of the amount of the rent at the time of booking.
The reservation will be confirmed only after receipt of the deposit by the Agency.
The balance will be settled 60 days prior to arrival. For bookings made less than 60 days before the date of arrival, the Tenant must pay the total cost of the rental at the time of booking.
No reservation will be considered confirmed before receipt of the deposit by the Agency and the signature of the rental contract.
If the balance is not received 60 days before the date of arrival, the Agency has the right to cancel the reservation.
This cancellation will result in the loss of the deposit by the Tenant.
In case of non-arrival, the entire stay will be charged. Please note that if the tenant does not show up on the day of their confirmed arrival, this will be considered a cancellation of the entire stay and the agency will be free to re-rent the villa.
ARTICLE 5 - SECURITY DEPOSIT
On arrival, the Agency will take the details of the Tenant’s credit card to cover any damage that may occur during his stay in the property.
In the event of damage caused in the property by the Tenant or the other occupants during their stay, the Tenant expressly authorizes the Agency to charge this credit card to cover the repairs caused, plus 5% processing fee.
If the Tenant finds damage in the property upon his arrival, he must immediately notify the Agency.
ARTICLE 6 - HOUSEKEEPING
Unless stated otherwise in villa's details, daily housekeeping (excepts on Sundays and Public holidays) is included in the rental rate.
The housekeeping does not include cleaning of personal belongings, which is on request, and paying.
Towels changed every two days
Beach towels changed every three days
Bed linen changed every three days
ARTICLE 7 - ACCOMMODATION RATES
Accommodation rates are indicated per night, in euros, or in dollars (VAT not applicable in St. Barthélemy), for one or two people per bedroom.
A minimum of 7 nights is required, shorter stay on request.
Each stay including Christmas or New Year’s Day will be charged on the basis of the holiday rate and over a period of 14 nights minimum.
The minimum length of stay including Thanksgiving Day may vary. Rates may be subject to change without notice.
ARTICLE 8 - LODGING TOURIST TAX
ARTICLE 9 - LIABILITY FOR PERSONAL EFFECTS AND PROPERTY
The objects and personal effects of the Tenant and other occupants of the property are under their sole responsibility.
Valuables must be placed in the safes provided for this purpose.
Neither the Agency nor the owner can be held liable in case of loss, damage or theft of these objects and/or personal effects.
ARTICLE 10 - INSURANCE
We recommend that the Tenant undertakes to take his/her own insurance covering the risks relating to his/her trip and his/her stay (cancellation of flight, lateness, loss of luggage,etc)
The Agency shall not in any way be held liable in the event of problems such as cancellation of flight, lateness, loss of luggage, etc (this list not being exhaustive).
Neither the Agency nor the owner can be held responsible in case of problems relating to the journey of the Tenant or other occupants of the property such as those mentioned above.
ARTICLE 11 - VISA REQUIREMENTS
The Tenant is required to verify whether or not a visa is required. It is the responsibility of the Clients to check with the Embassy of France the latest law in force for visa requirements.
Please note that no refund will be made and the entire stay will be charged if Guests are not allowed to enter the island.
ARTICLE 12 - CLAIMS IN DISPUTE
If the Tenant encounters a problem in the villa during his stay, he must inform the Agency immediately.
Only complaints registered by the Agency during the Tenant’s stay will be taken into consideration.
The Tenant agrees that this Agreement shall be governed by and construed in accordance with French law with respect to any request against the Agency.
In the event of a dispute, the competent court is the Tribunal de Basse Terre (Guadeloupe).
